Vitamin360 Loyalty Program Policy

Thank you for your interest in our Vitamin360 Loyalty Program. If you are over 18 years old, you can join at any time on our website. Participation in the Vitamin360 Loyalty Program will provide you with a number of benefits (promotions, discounts, gifts, etc.). As part of the Vitamin360 Loyalty Program, you will be rewarded with “vitaCOIN” points equal to the total amount of your order (excluding transport, handling and other charges), which will increase the benefits you received.

Below we explain in details the basic principles of how the Vitamin360 Loyalty Program works. The information we provide may seem very precise and detailed, but this is required by applicable law - we have tried to use the simplest possible language so that everything is as clear as possible for you to understand.

1. RULES AND CONDITIONS OF THE VITAMIN360 LOYALTY PROGRAM

1.1. The rules set out:

a) the principles of the operation of the Vitamin360 Loyalty Program;

b) the terms and conditions of participation in the Vitamin360 Loyalty Program, including the rigths and obligations of the Organiser and Participants;

c) the terms and conditions of the benefits provided to Participants, such as Gifts, Promotions, Additional Services and how they are determined;

d) the principles for the conduct of the Communication.

1.2. The purpose of the Vitamin360 Loyalty Program is to sell the Organiser’s products to Participants on the most favorable terms possible through special orders.

1.3. As part of the Vitamin360 Loyalty Program, the Organiser will create a Participant profile that allow Participants to use special benefits such as dedicated Promotions, Gifts, Additional Services or messages as part of their communications.

1.4. The Vitamin360 Loyalty Program is opened only to individuals who are 18 years of age or older and have full legal capacity.

2. DEFINITIONS

2.1. All capitalised terms used in these Rules shall have the meanings given to them below unless the context of their use indicates otherwise.

2.2. Definition:

a) Price - means the gross remuneration (plus all relevant taxes payable, including VAT) quoted by the Seller in Euro. The Price does not include delivery costs, unless otherwise provided for in the promotional terms and conditions applied by the Online Store;

b) Personal data - data of the identified or identifiable individual person Participants within the meaning of the GDPR;

c) Communication - means electronic communication between the Organiser and the Participant, mainly in the form of e-mail, and messages sent to the telephone number provided by the Participant, as well as correspondence by post. As part of the Vitamin360 Loyalty Program, the Organiser may communicate through other channels;

d) Account - An account within the meaning of the Vitamin360 online store rules - an electronic service, identified by an email address and password provided by the Customer (Participant), on the Seller’s (Organiser) IT system that allows the Customer to use additional features/services. The Customer (Participant) accesses the Account using the email address and password. The Customer (Participants) logs into his Account after registering in the Online Store. The Account allows you to store information about the Customer’s (Participant’s) address details for the delivery of Products, to track the status of the Order history and other services provided by the Seller (Organiser). The account also allows editing and storage of the Customer’s (Participant’s) Personal Data, access to the Policies, and access to the number of vitaCOINs achieved in the respective Account after enrollment in the Vitamin360 Loyalty Program.

e) Organiser - Vitamin360, a.s., Priemyselná street 6734, 929 01 Dunaszerdahely. Tax identification number (NIP): SK2022616068, e-mail address: info@vitamin360.com, telephone number: (+36) 627 6030 - the price of a normal call, determined by the telecommunication operator;

f) Gift - a benefit in kind, as determined by the Organizer, provided to a Participant in accordance with specific rules determined by the Organiser for the purpose of promoting and advertising the Organiser.

g) Vitamin360 Loyalty Program - the Organiser’s Loyalty Program, the specifics and rules of which are set forth in these Rules. The Vitamin360 Loyalty Program in Hungary is organized and administered by the Organiser. The purpose of the Vitamin360 Loyalty Program is to promote and advertise the Organiser, including increasing their visibility, encouraging the purchase of their products and the use of their services. No other Promotion or other special offer may be combined with the benefits of the Loyalty Program, unless the rules of that Promotion provide otherwise for special pricing or product offers.

h) vitaCOIN - points awarded to a Participant under the Vitamin360 Loyalty Program, the system of which is governed by the terms and conditions set forth in the Rules;

i) Promotion - special conditions of sale of the Organiser's products, such as discounts, rebates, vouchers, markdowns, vitaCOINs or other benefits to Participants, which are defined in specific rules and can only be used under the conditions set out therein;

j) Rules/Contract - This document sets forth the rules and features of the Vitamin360 Loyalty Program and the rules for the provision and use of the services provided by the Organiser through the Website. The Policy sets out the rights and obligations of the Participant and the Organiser. Services provided by electronic means are governed by the Act CVIII of 2001 on the provision of electronic services.

k) Sales Contract - a sales contract as defined in the Terms and Conditions of the Vitamin360 Online Store;

l) Participant - a natural person over the age of 18 who has registered and joined the Vitamin360 Loyalty Program as described in the Rules.

m) Additional Services - an additional service provided electronically by the Organiser to Participants as part of the Vitamin360 Loyalty Program on the terms and conditions set out in the Rules;

n) Internet Site - the Organizer's Internet Site, available at https://hu.vitamin360.com/, is an online web store within the meaning of the Vitamin360 Website Rules, i.e. an Internet site, a platform that allows orders to be placed by the Customer (Participant) and the provision of services that are a set of interconnected websites operated by the Seller (Organiser).

3. GENERAL PROVISIONS

3.1. In connection with participation in the Vitamin360 Loyalty Program, the Organiser may:

a) analyse Participants' behaviour and preferences, including by automated means. It may store profiles created by Participants in order to develop offers to Participants, including Promotions;

b) organise Promotions and reward Participants with Gifts;

c) send messages to Participants

3.2. Organisation of the Vitamin360 Loyalty Program in Hungary.

3.3. Participation in the Vitamin360 Loyalty Program is voluntary and without any fee.

3.4. A Participant may join the Vitamin360 Loyalty Program at any time during its term.

3.5. Participants may not transfer their rights under the Vitamin360 Loyalty Program to any third party.

3.6. A Participant may participate in the Vitamin360 Loyalty Program subject to these rules and generally accepted standards. A Participant must:

a) provide true, current and complete information at the time of registration.

b) promptly notify the Organiser of any changes to the Personal Data provided at the time of registration;

c) use all services and functionality of the Vitamin360 Loyalty Program provided by the Organiser in a manner that does not interfere with the operation of the Vitamin360 Loyalty Program, other Participants or the Organiser.

d) You may not distribute or transmit any content within the Vitamin360 Loyalty Program that is prohibited by applicable law, in particular content that infringes the copyright or personal rights of third parties (prohibition of publication of illegal content);

e) refrain from actions such as:

-information technology activities or other activities that are intended to obtain information that does not belong to a Participant, including information about other Participants, or that violate the principles or interfere with the technical operation of the Vitamin360 Loyalty Program;

-Unauthorized modification of content provided by the Organiser.

4. FULFILMENT OF THE CONTRACT

4.1. Terms and conditions for joining the Vitamin360 Loyalty Program:

a) Age of majority and legal capacity;

b) Establish an account or use an existing account

c) The Participant has read and accepted the Rules and Regulations.

4.2. Once the requirements for participation in the Vitamin360 Loyalty Program are met as set forth in Section 4.1 above, the person joining the Vitamin360 Loyalty Program becomes a Participant. Upon entering into the Agreement, the Participant will be given access to his/her Account, allowing him/her to see how many vitaCOINs he/she has.

5. vitaCOIN TRADE SYSTEM:

5.1. vitaCOINs shall be awarded to the Participant in accordance with the terms and conditions set out in the Rules.

5.2. The Participant will receive vitaCOINs based on the following conversion rate: 100 vitaCOINs are equal to 1 EUR spent on the Website. Using this conversion rate, the basis for calculating the vitaCOIN is the price actually paid by the Participant in accordance with the Purchase Agreement with the Organiser. In the case of other currencies used on our site, (HUF, USD, PLN, RON, CZK), the current EUR exchange rate as determined by us.

5.3. The Participant will automatically receive the vitaCOINs received for the purchase on the Site after the conclusion of the Purchase Agreement. For the avoidance of doubt, the Organiser will indicate that the vitaCOINs will not be awarded if the Participant actually withdraws from the Purchase Agreement.

5.4. In the event that the Participant effectively withdraws from the Purchase Agreement, the vitaCOINs (according to the price that was due at the time the Purchase Agreement was entered into between the Organiser and the Participant) will be adjusted or deducted from the vitaCOINs in the Account.

5.5. The Organiser reserves the right to cancel any vitaCOINs that have been recorded contrary to these Rules or separate Promotion Regulations.

5.6. Information on the current quantity of vitaCOINs is available in the Participant's account.

5.7. vitaCOINs may expire in the following cases:

a) in the event of termination by the Organiser under the conditions set out in clause 8 of these Rules;

b) in the event of the Participant's effective withdrawal from or termination of participation in the Vitamin360 Loyalty Program, subject to the terms and conditions set forth in Section 8 of these Rules.

c) upon the cancellation of the Participant's Account to which the Points have been assigned

d) 360 days have elapsed from the date of the order after which the vitaCOIN quantity has been credited

5.8. The Participant is not entitled to exchange vitaCOINs received from the Organiser for cash or any other benefit, such as a benefit in kind, under these Rules.

5.9. In the event of re-enrollment in the Vitamin360 Loyalty Program, the Participant shall not be entitled to a refund of previously expired vitaCOINs.

6. THE STATUS OF THE PARTICIPANTS DEPENDS ON THE AMOUNT OF VITACOIN

6.1. Depending on the number of vitaCOINs registered in the Account, Participants may achieve the following statuses:

a) 0 - 24 999 vitaCOIN status: "MEMBER";

b) 25 000 - 49 999 vitaCOIN status "ELITE";

c) 50 000 - vitaCOIN status "VIP".

6.2. Depending on the amount of vitaCOINs registered in the Participant's Account, the status of the Participant will always change. The classification is based on the current vitaCOIN balance, taking into account the turnover of the last 360 days.

6.3. The Organiser may, in its sole discretion, organise Promotions, giveaways or provide Additional Services only to Participants who have achieved the statuses set out in the rules described in Section 6.

7. DISCOUNTS AND LIMITS

7.1. Participation in the Vitamin360 Loyalty Program provides Participants with the following discounts, depending on their status:

a) MEMBER: -5% on non-discounted products.

b) ELITE: -7.5% on non-discounted products.

c) VIP: -10% on non-discounted products.

7.2. In the case of ELITE and VIP status, the discount obtained can be used from the next purchase after the purchase that results in the attainment of the status defined in section 6.1.

7.3. Discounts available under the Vitamin360 Loyalty Program may not be combined with any other promotion, action, discount or rebate, unless otherwise stated in the terms and conditions of the relevant promotion / action / discount / rebate. The Participant is not entitled to request the Organiser to exchange the discount for cash or any other benefit, including benefits in kind.

8. TERMINATION OF CONTRACT BY THE ORGANISER

8.1. The Organiser intends to maintain the Vitamin360 Loyalty Program indefinitely.

8.2. The Organiser may terminate the contract with one month's notice in the following specific cases:

a) in the event of a change in the legal provisions governing the provision of services by the Organiser that affect the mutual rights and obligations set out in the contract between the Participant and the Organiser.

b) Likewise, in so far as the interpretation of the - above regulations - judicial and administrative - decisions, - rulings, -

c) changes in the way services are provided solely for physical or technological reasons;

d) in the event of a change in the legal form of the Organiser, in the event of a change in the other identification data of the Organiser specified in these Rules (to the extent necessary to update such data), where this makes it impossible or limits the implementation of the provisions of these Rules;

8.3. The Organiser may terminate the Participant's contract and/or deny the Participant the right to participate in the Vitamin360 Loyalty Program with five days' notice, and may restrict access to the content referred to in clause 12 for cardinal reasons in certain cases. Any breach of these Rules by a Participant shall constitute a breach of the provisions of Clauses 3.5 and 3.6 above.

8.4. The Organiser will forward its statement to the e-mail address or telephone number provided by the Participant at the time of registration, as specified in Clauses 8.2 to 8.3 above.

8.5. In the event of termination of the Contract as set out in these Rules, the Promotions shall remain valid for the period specified by the Organiser in separate rules/regulations, but not longer - than the actual term of the Contract.

.6. In the event of cancellation of an Account, including for the reasons set out in the Vitamin360 Web Store Rules, the Contract with the Participant shall terminate without notice at the moment of cancellation of the Account.

9. COMPLAINTS AND OUT-OF-COURT SETTLEMENTS

9.1. Complaints regarding the Vitamin360 Loyalty Program should be sent to the Organiser at info@vitamin360.com or by telephone at (+36) 70 627 6030, the fee for which is determined by the applicable telecommunications service provider's agreement with the Organiser.

9.2. In order to facilitate the handling of complaints, the Complainant is advised to send the personal data provided for in the legislation in force and in the GTC (https://hu.vitamin360.com/terms) to the Service Provider, as well as the exact details of the complaint.

9.3. The Organiser will respond to the complaint without delay, but no later than within 30 days of receipt of the complaint (in accordance with the relevant provisions of the Consumer Protection Act CLV of 1997 in force).

9.4. Participation in the Vitamin360 Loyalty Program shall not affect or modify the rights of the Participant under the provisions of the law, including the rights that the Participant has under the laws applicable to consumers.

9.5. If the Organiser has committed an infringement of the law against a customer who is a consumer, the consumer may initiate a consumer protection procedure at the government office competent for his/her place of residence.

10. PERSONAL DATA OF PARTICIPANTS

10.1. The Organiser is the controller of the Participant's Personal Data

10.2. The provision of the personal data that the Participant is required to provide during registration is voluntary, but is necessary for the conclusion of the Contract and for participation in the Vitamin360 Loyalty Program.

10.3. The processing of Personal Data within the Loyalty Program involves the listing of a Participant's Personal Data and his or her activities on the Internet. This is necessary for the performance of the Agreement in order for the Organiser to automatically provide the Participant with benefits such as Promotions, Gifts, Additional Services or messages as part of Personalised Communications, together with the analysis and prediction of the Participant's personal preferences based on the Personal Data processed.

10.4. Detailed information on the protection of personal data can be found in the "Privacy Notice" on the website (https://hu.vitamin360.com/privacy-policy).

11. CHANGES TO THE RULES

11.1. The Organiser may amend the Rules for the following exceptional reasons:

a) in the event of a change in the legal provisions governing the provision of services by the Organiser that affect the reciprocal rights and obligations set forth in the Agreement, or in the event of a difference in interpretation of the provisions of the above law as a result of a court ruling, decision, recommendation or guidance of any agency or body having jurisdiction in the matter;

b) change the way the service is provided for technical or technological reasons only;

c) change the scope or provision of the services covered by the Regulation by introducing new Rules, modifying or withdrawing functions or services covered by the Regulation;

d) in the event of a merger, division or transformation of the Organiser, or a change in the Organiser’s other identifying information as specified in these Rules (to the extent necessary to update such information);

e) change the terms of the offer of products offered by the Organiser, suppliers or manufacturers

11.2. If the Rules are amended, the Organiser will publish a consolidated version of the Rules on the Website and will notify the Participants of the changes to the Rules by sending a message to the Participants' e-mail addresses, which the Parties acknowledge by reading the content of the information sent electronically.

11.3. Amendments to the Rules will enter into force 14 days after the date on which the information about the change has been sent. The Participant has the right to terminate the Agreement within 14 days of the date of notification of the amendment to the Rules. This does not affect the Participant's right to withdraw from the Vitamin360 Loyalty Program at any time without giving a reason.

12. TERMINATION / WITHDRAWAL OF THE CONTRACT

12.1. If you do not wish to participate in the programme while logged in to the online shop, you can delete your profile and exit the loyalty programme by going to the Edit data menu.

13. FINAL PROVISIONS

13.1. Date of validity of the Rules: 2024-01-24.

13.2. The full text of the Rules is available on the Website.

13.3. The Organiser shall conclude the contract in Hungarian. Consolidation, provision and publication of the essential provisions of the Contract concluded through the Website will be made by e-mail to the e-mail address provided by the Participant.

13.4. The Organiser will take technical and organizational measures appropriate to the magnitude of the threats to the security of the functions or services provided through the Website. The use of the Website may involve typical risks associated with the transmission of data over the Internet, such as transmission, loss or unauthorised access.

13.5. In matters not covered by the Regulations, the generally applicable provisions of Hungarian law shall apply.
